Terms & Conditions

These Terms & Conditions govern all reservations and stays at 99 On Zwartkloof (“the Property”). By confirming a booking and/or making payment, the Guest acknowledges that they have read, understood, and agree to be bound by these Terms.

1. Booking & Payment Policy
1.1. A reservation is confirmed only upon receipt of a 50% non-refundable deposit of the total booking value.
1.2. The remaining 50% balance must be paid no later than 14 (fourteen) days prior to the arrival date.
1.3. Should the balance not be received by the due date, the Owner reserves the right to cancel the booking and retain the deposit.
1.4. Bookings made within 14 days of arrival require 100% payment upfront.
1.5. No access to the Property will be granted unless full payment has been received and cleared.
1.6. Payment is accepted via online secure 3D link, bank transfer or EFT only.
1.7. Each booking will include the below:
1.7.1. Admin/Booking fee R500
1.7.2. Departure cleaning fee R350
1.7.3. Reserve conservation fee of R100 per car
1.8. Bookings will only be confirmed once the following are received from Guests:
1.8.1. Verified proof of at least 50% deposit
1.8.2. Signed House, Reserve Rules and Terms and Conditions
1.8.3. Completed Guest Information Form
1.9. No check in details will be shared with guests until all required documents and payments have been received.
1.10. The lead Guest must be at least 30 (thirty) years of age and must present valid identification upon request.
1.11. False identity or third-party bookings not disclosed will result in cancellation without refund.

2. Breakage & Noise Deposit
2.1. A refundable Breakage and Noise Deposit of R5,000 is payable prior to check-in.
2.2. The deposit will be refunded within 7 (seven) working days after departure, provided that:
2.2.1. No reserve or noise rules were violated
2.2.2. No damage has occurred to the Property or its contents
2.2.3. No items are missing
2.3. Any damages, penalties, or excessive cleaning costs will be deducted from the deposit.
2.4. Should damages exceed R5,000, the Guest agrees to remain fully liable for the outstanding amount.
3. Cancellation Policy
3.1. Cancellations made more than 21 days prior to arrival will receive a refund of payments made, less any administrative or transaction fees.
3.2. Cancellations made 21 days or less prior to arrival will result in 100% forfeiture of the total booking value.
3.3. Early departures or no-shows do not qualify for refunds.
3.4. Refunds will be processed within 7–10 working days via the original payment method.

4. Check-In & Check-Out
4.1. Check-in: From 14:00
4.2. Check-out: By 10:00
4.3. Guests who arrive later than 21:00 will not be allowed entry into the Reserve.
4.4. In the event of unforeseen delays, guests must notify in advance if they expect to arrive after 21:00. Failure to notify will result in access being denied.
4.5. Guests leaving the Property or the Reserve during their stay must also ensure they return before 21:00, as late re-entry is not permitted under any circumstances for security purposes.
4.6. Late check-out without prior written approval may incur additional charges.

5. Maximum Occupancy & Visitors
5.1. The number of guests may not exceed the number confirmed in the booking.
5.2. No additional visitors or day guests are permitted without prior written approval.
5.3. Overcrowding will result in immediate cancellation of the stay without refund.

6. Reservation Changes & Booking Transfers
6.1. Date changes are subject to availability and any additional fees.
6.2. The transferring of bookings, assigning rights or subletting the property is strictly prohibited.
6.3. Only registered guests may occupy the property.

7. Noise & Conduct Policy – Respect the Bush
7.1. No parties, loud music, shouting, DJs, sound systems, events, or excessive noise or any noise disturbance is permitted at any time especially during quiet hours.
7.2. No birthday, bachelor, bachelorette parties or gatherings are permitted.
7.3. Quiet hours must be strictly observed (18:00–07:00)
7.4. Any noise complaint may result in immediate eviction.
7.5. Guests must respect neighbouring properties and the natural surroundings.
7.6. Any fines imposed by the reserve or homeowners association due to guest behaviour will be deducted from the deposit or charged additionally if necessary.
7.7. Failure to comply may result in immediate eviction without refund.
7.8. Misrepresentation & Parties:
7.8.1. By confirming a booking, the Guest warrants that the booking is made for lawful accommodation purposes only and not for any form of party, event, or gathering.
7.8.2. Should it be determined that the Guest made the booking under false pretences, including but not limited to stating that no party would be held and thereafter hosting a party or gathering of any kind, the Owner reserves the right to impose penalties and/or terminate the stay immediately without refund.
7.8.3. For the purposes of this agreement, a “party” or “gathering” includes any social event involving non-registered guests, music, celebration, or behaviour inconsistent with quiet residential use, whether or not noise levels are deemed excessive by the Guest.
7.8.4. A noise complaint received from the Reserve, HOA, security, or neighbouring property shall be deemed sufficient evidence of a breach of this clause.
7.9. Penalty Structure
7.9.1. Upon receipt of a first noise or conduct complaint, a penalty fee of R5,000 shall be charged immediately and deducted from the deposit or charged separately.
7.9.2. Upon receipt of a second complaint, the Guest shall be evicted immediately without any refund, and the full deposit shall be forfeited.
7.9.3. No exceptions shall apply.

8. No Pets Policy
8.1. Pets are strictly prohibited.
8.2. Violation of this rule will result in immediate removal and forfeiture of the breakage deposit.

9. Nature Reserve & Wildlife Disclaimer
9.1. The Property is located within a wildlife environment and is not fenced.
9.2. Guests acknowledge that wildlife may roam freely and may approach or enter the immediate vicinity of the house.
9.3. Guests enter and use the Property entirely at their own risk.
9.4. Feeding, approaching, or disturbing wildlife is strictly prohibited.
9.5. The Owner shall not be held liable for injury, loss, or damage arising from wildlife encounters.

10. Property Care & Utilities
10.1. Guests agree to:
10.1.1. Treat the Property, its contents and staff with care and respect.
10.1.2. Switch off lights, air conditioning, and electrical appliances when not in use or when leaving the Property.
10.1.3. Ensure all windows and doors are closed and secured when leaving.
10.1.4. Use water responsibly.
10.1.5. Leave the Property in a neat and reasonable condition.
10.2. Failure to comply may result in deductions from the deposit.
10.3. Loss of keys, remotes, or access devices will result in replacement and reprogramming costs being charged to the Guest.

11. Security Cameras
11.1. External security cameras may be in use at the Property entrance and driveway for safety and compliance monitoring. No cameras are installed inside the house.

12. Liability
12.1. Guests occupy the Property at their own risk.
12.2. The Owner shall not be liable for:
12.2.1. Loss or theft of personal belongings
12.2.2. Injury, death, or accidents during the stay
12.2.3. Power outages, water interruptions, or force majeure events
12.2.4. Acts beyond the Owner’s reasonable control
12.3. Guests are responsible for ensuring their own safety and that of all persons within their party.

13. Right of Refusal & Eviction
13.1. The Owner reserves the right to:
13.1.1. Refuse entry to any guest not complying with these Terms
13.1.2. Cancel a stay without refund in cases of misconduct
13.1.3. Recover costs for damages or violations
13.1.4. Evict guests who show aggressive, rude, disruptive or unsafe behaviour
13.2. The Owner or authorised representative reserves the right to access the Property during the stay for emergency, maintenance, or inspection purposes 
where reasonably required.

14. Indemnity
14.1. The Guest hereby indemnifies and holds harmless the Owner of 99 On Zwartkloof as well as the Homeowners Association from any claims, damages, losses, or liabilities arising from the Guest’s stay, including but not limited to negligence, misuse of facilities, or breach of these Terms.
